After meeting with hundreds and hundreds of potential clients during our free consultations the same issues arise over and over again. The following are the top ten most common issues that should be addressed or followed prior to filing either a chapter 7 bankruptcy or chapter 13 bankruptcy case.

10. Do Not Wait To Speak To An Experienced Bankruptcy Attorney

Even if you are not ready to file bankruptcy speaking with an experienced bankruptcy attorney will give you the information you need to make educated decisions. To determine if you are speaking with an experienced bankruptcy attorney, ask the attorney how many other areas of law they practice, how long they have practiced bankruptcy law, how many bankruptcy cases have they filed and to name the trustees in the jurisdiction and what document requirements each trustee requires. If the attorney does not know who the trustees are and what each of them requires they do not regularly file bankruptcy cases. One the most common problems we face is meeting with potential clients when it is already too late. If you have been served with a summons and complaint you need to speak with a bankruptcy attorney. If you owe taxes and the IRS or FTB has indicated they are going to garnish your wages you need to speak with a bankruptcy lawyer.

9. Review Your Monthly Expenses

All consumer bankruptcy petitions include Schedule J. Schedule J is the estimate of the average or projected monthly expenses for your household at the time the bankruptcy case is filed. 7. Review and Document Self-Employment or 1099 Income

If you are self-employed or receive 1099 income it is essential that you know what your income is and what your expenses are for each of the six-months prior to filing for bankruptcy. Just like in Number 6 below, the Means Test uses a six-month average of your income to determine if you have disposable income available to creditors each month. Determining what your take home pay is when self-employed or receiving 1099 income is always more time consuming, but absolutely necessary prior to filing bankruptcy.

6. Save Your Pay Stub or Proof of Income Each Month

In 2005 Congress passed the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) changing the bankruptcy code and creating what is commonly called the Means Test. The Means Test is based upon local and national standards for expenses. The Means Test also uses the six-month average of your gross income extrapolated to a twelve months. You will need all six months of your pay statements or other proof of income.

5. Do Not Take a Cash Advance on a Credit Card

Taking a cash advance close in time to filing bankruptcy can be a huge problem. This can be a problem for the same reasons detailed in Number 4 listed below. It really depends upon the circumstances, but if you take a $5,000 cash advance on a credit card three weeks before filing bankruptcy you will probably hear from the credit card company when you file bankruptcy. We meet with client after client that has unfortunately borrowed or withdrawn from their retirement accounts all of their retirement money trying to pay off debts or stay afloat. You must weigh all the positives and negative before choosing to withdraw or borrow against your retirement accounts. Bankruptcy provides exemptions that can protect for the average person all of their retirement funds. You can file bankruptcy and still keep your retirement.

Anyone that files for bankruptcy protection must disclose all income, expenses and assets in their petition. If you plan to travel through the western provinces on your motorcycle you might want to look into the many popular tourist attractions, and the great roads to travel.

In order to rent in most cases you will need to have a major credit card. Requirements may vary from each province. Be sure to reserve your motorcycle ahead of time during peak travel times, which are usually from mid May to November.

Camping With Your Motorcycle

Most Canadian provincial and national parks, private campgrounds and other conservation areas allow you to camp with your motorcycle.

Other things to consider while driving throughout all the Canadian provinces on a motorcycle are that you are allowed to make a right turn on red lights in most cities throughout the country after coming to a complete stop. In all Canadian provinces pedestrians have the right-of-way and you must yield to pedestrians at crosswalks. The speed limit on the most rural highways is usually around 90-100 km/hr or about 55-65 mph. Speed limits are enforced mainly by the RCMP in rural areas, and municipal police in most major cities throughout Canada.

If you are pulled over by a police officer you must provide proof of insurance, driver’s license and registration.

Weather

Many people who are not from Canada picture the country as having vast piles of snow and snowmobiles as the main mode of transportation. Nothing could be more false. In most provinces you can ride a motorcycle 8-9 months out of the year. In Vancouver British Columbia and other western cities and towns, people drive year round. The summer months can get very humid in Canada, and there are many Canadian motorcycle events held across the country on an annual basis.

Motorcycle Insurance Canada, Driver’s License and Permit

If you plan a ride a motorcycle through Canada and you are from the United States., your driver’s license is valid in Canada. Be sure to bring proof of motorcycle insurance by talking to your insurance company for a free Non-resident Inter Provincial Motor Vehicle Liability Insurance Card before you leave, or carry your policy itself.

If you’re driving a borrowed motorcycle, you should bring a letter signed by the owner that says you are allowed. Also for a rented motorcycle, carry a copy of the rental contract.

Should You Dump A Commitment Phobe? Not Before You Read This

Having personally suffered from severe commitment phobia for many years, I know that being in love with someone who is afraid of commitment is not fun at all, but does someone’s fear of commitment always have to be the end of a relationship?

In real life, some people are not really meant to be together, and sometimes when you’ve tried everything humanly possible — and I mean really tried everything including asking for divine intervention — and failed, it’s smart to know when to walk away.

Walking away does not necessarily mean you will be able to stop loving that person because if you really love someone from your heart and soul you will never stop loving that person. Love is so much bigger than all of us because it’s the very fabric by which we are made of. And when you love someone what you are basically doing is getting in touch with what you are made of. Trying to stop love is like trying to get out of your own skin — good luck with that!

Walking away or “getting over” that person means that you stop expecting him or her to give you what he or she in unable to, is unwilling to, or just doesn’t want to. And sometimes that something is commitment.

But I think a lot of people walk away too soon. This is the sad reality of the “modern” world we live in. We think that relationships come in little neat packages with instructions “Add A Little Sex And Live Happily Ever’. Many people don’t realize that relationships need time and work. And with all the advice about “too many fish in the sea”, walking away seems the coolest thing to do. It shows that you “don’t care” and from where this kind of advice comes from, that is supposed to be a good thing. But many years later — just like the people who gave you the advice — you are still trying to “catch fish” in that sea. What does it say about you if you can’t catch even one fish in a sea with too many fish?

Many more aren’t willing to work as hard to make a relationship work as they work hard in their professions or careers. These same people start pushing premature commitment because of their own internal pressures and are quick to conclude it isn’t working and walk away.

And then there are some people who try to work things out but go about it the wrong way — nagging, begging, blaming, guilt tripping, giving ultimatums, playing break-up on and off again games etc. This very same things you do to try to get a “commitment” are the very things that make a commitment phobe even more weary of committing or run like an escaped death-row convict.

So true, being in love with someone who is afraid of commitment is hard, but commitment phobia is not a “terminal illness”.

Men and women do get over their fear of commitment. I did. And you probably have heard or know of many men and women who were written off as commitment phobes by the people they were in a relationship with and two months later they have committed to someone else. And the person who dumped the commitment phobe is left confused, angry, jealous, bitter and feeling terribly inadequate — like something is so wrong with her/him that someone who could never commit to them, had no problems committing to the next person.

Sometimes what a commitment phobe needs is:

– someone who doesn’t automatically assume that it’s all a selfish act but understands and appreciates where the fear and anxieties are coming from (fear of losing one’s independence, fear of marriage, fear of intimacy, fear of having kids, fear of financial burdens, fear of sharing a home, fear of offending family members, fear of moving to another state or country etc). Understanding and appreciation can help the two of you come to a compromise you can both live with.

– someone who is emotionally well enough and emotionally secure enough to give some real tough-love; Many commitment phobes have been through so many relationships and know exactly how the script plays out. Having a game-changer who will not play by the script can sometimes be the “shock therapy” a commitment phobe really needs.

– someone who is committed to really helping the commitment phobe get to that place where he or she feels “safe” enough to come out of their hiding place. Commitment phobia, like all fear, is really a wall to hide behind. And seeing that there is really nothing to fear is a great relief to a commitment phobe.

So before you walk away, make sure that you’ve earned your way out — that is given it everything you got and more. That way you don’t look back with regret because you dumped someone you still love and a few months later he or she commits to someone else.
